Privacy Policy

Muscle + Brawn is an independent news, information, and commentary website covering strength training, fitness, and related health topics. This privacy notice governs our privacy practices when you use our website, Muscle + Brawn, and any related services (collectively, the "website"). We are a content publisher — we do not provide personal coaching, training programs, or paid coaching services, and we do not sell products directly to you through the website.

This privacy notice tells you what personal data and nonpersonal data we collect from you, how we collect it, how we protect it, how we share it, how you can access and change it, and how you can limit our sharing of it. It also explains certain legal rights you have concerning your personal data. Any capitalized terms not defined here have the same meaning as elsewhere on our website.

Terms used throughout this notice

NPD — Nonpersonal Data
Any information that is in no way personally identifiable.
PD — Personal Data
Any information relating to an identified or identifiable natural person — a name, ID number, location data, online identifier, or other factor specific to that person's identity. It's broader in scope than PII.
SPD — Sensitive Personal Data
Includes SSNs, account log-in or financial details with credentials, exact geolocation, racial or religious data, private communications, genetic or biometric data, health information, and sex life or orientation — even if publicly available.

01Your Rights

Contact us using the information at the bottom of this notice to exercise any of your legal rights. We'll respond within 30 days of receiving your request.

When you use our website and submit PD to us, you have certain rights under privacy laws in the United States — including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) — and under privacy laws of other countries, including the EU and UK GDPR. Even where not legally required, we make reasonable efforts to honor data subject access requests. We reserve the right to decline any request we're not legally obligated to comply with. Your rights include, but are not limited to:

  • Equal service and price, and no discrimination for exercising your privacy rights.
  • One or more means of submitting requests, including at minimum an email address.
  • The right to know whether your PD is sold, shared, or disclosed, and to whom.
  • The right to request that we not sell or share your PD.
  • Disclosure of categories of PD collected, sources, purposes, and third parties it's shared with.
  • The right to be informed about the PD we collect and how we process it.
  • The right to confirm your PD is being processed and to access it.
  • The right to have inaccurate or incomplete PD corrected.
  • The right to request deletion of your PD, subject to legal exceptions.
  • The right to restrict or “block” further processing of your PD.
  • The right to receive PD you provided in a portable format, within 30 days.
  • The right to object to processing based on legitimate interests, direct marketing, or research.
  • The right not to be subject to solely automated decisions with significant effects.
  • The right to have collection limited to what's adequate, relevant, and necessary.
  • The right to designate an authorized agent, subject to identity verification.
  • The right to file a complaint with a supervisory authority.

Your California Privacy Rights

California consumers have rights under the CCPA and CPRA, including the right to know what personal information we collect and whether it's sold or disclosed, the right to say no to sale of your information, the right to access, correct, and delete it, the right to data portability, and the right to equal service and non-discrimination. To comply with some of these rights, we must be able to reasonably verify your identity.

02Information We Collect and How We Collect It

As an independent news and information website, we collect far less PD than a site that processes purchases or coaching engagements. Generally, you control the amount and type of information you provide to us.

Our legal basis for collecting your PD — where you subscribe to our newsletter, post a comment, register an account, or otherwise provide PD voluntarily — is your consent. Where we process PD to operate, secure, and improve the website, our legal basis is our legitimate interest, balanced against your rights.

Automatic Information

We automatically receive information from your browser or device, including your IP address, ISP name, browser and device type, operating system, and browsing activity on our website (articles read, time on page). We use this to understand readership and improve the site.

By agreeing to accept cookies, you give us and our third-party partners permission to place, store, and access some or all of the following on your device:

Location Information

We may collect general, non-precise location information (country or region derived from your IP address) to understand readership and comply with regional privacy laws. We don't collect precise GPS location.

Google Services

Your use of our site is subject to the Google Privacy Policy and Terms of Service. We follow the Google API Services User Data Policy where relevant. We use Google Analytics to understand website usage and demographics; we don't combine this data with PD. You can opt out at tools.google.com/dlpage/gaoptout.

Advertising & Affiliate Links

As an ad- and affiliate-supported news site, third-party vendors — including Google — use cookies to serve ads based on your past visits to our site and others. Opt out of interest-based Google advertising at aboutads.info/choices (EU users: youronlinechoices.eu). Some articles contain affiliate links; if you click one and buy something, we may earn a commission, as disclosed in our Affiliate Disclosure. We don't receive your payment details from these transactions. We also participate in the Amazon Associates program and may use Amazon's remarketing pixels — manage preferences at amazon.com/adprefs.

If you don't give us your PD: you can read and use nearly all of our website without providing any. You just won't be able to subscribe to our newsletter, post comments, or use similar optional features.

03How Your PD Is Used and Shared

We use the information we receive to operate, secure, and improve the website; deliver the newsletter or content you've requested; personalize what you see; respond to your questions; resolve disputes; and, where you've consented, send updates about our content or relevant advertising.

Communications and Emails

We use the email address you provide to send promotional or editorial emails unless you opt out. Change your preferences anytime using the unsubscribe link in our emails or by contacting us.

Sharing With Third Parties

We don't sell or rent your PD to third parties for marketing purposes. We may use NPD for data-aggregation purposes and monetize it at our discretion; aggregated data won't contain your PD. We may share your PD with service providers who support our operations — analytics, advertising and affiliate networks, email providers, comment-moderation tools, hosting, and professional advisors. If you sign in via a third-party social service to comment, limited profile information may be shared with us; we don't control those services' privacy practices.

Legally Required Disclosures

We may disclose your PD where required by subpoena, law, or legal process; to assist law enforcement; to protect ourselves from legal claims; or to protect the rights, property, or safety of our company, readers, employees, or partners.

Business Transfers

If our business is sold, merges, or transfers in whole or part — or in the event of bankruptcy — we retain the right to transfer your PD to the successor entity, which would use it under this notice or any updated version it adopts.

Comments and Community Features

If you comment or post publicly, exercise care about sharing PD — content you post publicly isn't protected by this notice, and we're not liable for PD you choose to disclose. Content you post may be visible worldwide, and we can't fully control its use or misuse by others.

04Retaining and Destroying Your PD

We retain PD only for as long as it serves the purpose it was collected for, or as needed for legal, business, or tax purposes. We attempt to erase or anonymize PD once it reaches the end of its retention period, or upon a valid request from you. Some data may persist temporarily in backup systems awaiting routine deletion; this data isn't readily accessible to our systems, employees, or contractors in the ordinary course.

05Protecting the Privacy Rights of Third Parties

If you post content that references third parties, you confirm you have permission to include that information. We aren't legally liable for the actions of our readers, but we'll remove postings brought to our attention that violate the privacy rights of others.

06Do Not Track Settings

Some browsers let you signal that you don't want your activity tracked across a website. Our website does not currently respond to Do Not Track signals. You can adjust tracking and other privacy settings directly in your browser.

08Protecting Children's Privacy

Our website is not designed for use by anyone under the age of 18, and we don't knowingly collect PD from children under 18. If you're a parent or guardian and believe your child is using our website, please contact us. We may request proof of identity before removing account information to prevent malicious removal requests. If we learn a child under 18 has provided us PD, we'll delete it within a reasonable time. We don't verify the age of our readers and have no obligation to do so.

09Our Email Policy

You can opt out of receiving email from us or our affiliates at any time. We won't sell, rent, or trade your email address to an unaffiliated third party without your permission, except in connection with a sale or transfer of our business, or bankruptcy, as described above.

10Our Security Policy

We use industry-standard security measures and authentication tools to protect your PD, and we and our service providers maintain technical and physical safeguards. We can't guarantee against loss, misuse, or interception of PD due to the inherent nature of internet transmission. Please protect any account password and don't share it with anyone.

11Transferring PD From Other Countries

PD we collect may be stored, processed, and transferred among countries in which we or our service providers operate, including the United States. The European Union has not found the U.S. to provide an adequate level of PD protection under Article 45 of the GDPR. We rely on the derogations available under Article 49 of the GDPR for specific situations, and, where appropriate, enter into data processing agreements and standard contractual clauses. If you're located outside the U.S., by using our website you consent to the transfer of your PD as described in this section.

12Changes to Our Privacy Notice

We may change this notice at any time. We'll post any changes on our website so readers are always aware of what we collect, use, and disclose. If we intend to use or disclose your PD in a materially different way than described when it was collected, we'll provide advance notice by email to the address on file, where applicable. Otherwise, we'll use and disclose PD according to the notice in effect at the time it was collected. Your continued use of our website after a change to this notice constitutes acceptance of that change.
